  • All subscription fees are billed in advance, either monthly or annually, depending on the selected plan.
  • Accepted payment methods include major credit cards and other payment options as specified during checkout.
  • All prices are listed in USD, and you are responsible for any applicable taxes or transaction fees imposed by your payment provider.
2. Free Trial

We offer a 7-day free trial for new users to explore our services. During the trial period:

  • You will have access to all features available in the selected subscription plan.
  • You will not be charged until the 7-day trial period ends.
  • If you do not wish to continue with the subscription, you must cancel your trial before the end of the 7-day period to avoid being charged.

If you do not cancel the subscription during the trial period, your payment method will be automatically charged for the first billing cycle at the end of the trial.

3. No Refund Policy

All payments made to MCAT Elite are non-refundable. This includes, but is not limited to:

  • Subscription fees billed after the free trial period.
  • Partial or unused subscription periods.

We recommend using the 7-day free trial to evaluate our services before committing to a subscription. If you choose to cancel your subscription, you will retain access to the service until the end of your current billing cycle.

4. Subscription Cancellation

You can cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing cycle, and you will not be charged for subsequent cycles.

5. Changes to Pricing

MCAT Elite reserves the right to change its subscription pricing at any time. In the event of a price change, we will notify you in advance, and the changes will apply to your subscription upon the next billing cycle.

Termination of Service

At MCAT Elite, we value your experience and provide flexibility to manage your account and subscriptions. However, there are circumstances under which your access to our services may be terminated. Termination by You

You may choose to terminate your subscription or delete your account at any time by following these steps:

  • Cancel a Subscription: Navigate to the Account page in your account settings. Select the subscription you wish to cancel and follow the prompts. Your subscription will remain active until the end of the current billing period, and you will not be charged for subsequent periods.
  • Delete Your Account: Go to the Account page and select the "Delete Account" option. Once deleted, your account, personal data, and any progress or saved materials will be permanently removed and cannot be recovered.
Termination by MCAT Elite

We reserve the right to suspend or terminate your access to our services under the following circumstances:

  • Non-payment or failure to resolve billing issues after repeated attempts to contact you.
  • Suspected fraudulent activity, unauthorized use of your account, or other security concerns.

If we terminate your account, we will notify you via the email associated with your account. In cases of severe violations, termination may be immediate and without prior notice.

Effect of Termination

Upon termination of your account:

  • Your access to all services, materials, and resources provided by MCAT Elite will be revoked.
  • If you have an active subscription, no refunds will be provided for any unused portion of the billing period, unless required by applicable law.
Reactivating Your Account

If your account was terminated due to inactivity or at your request, you may contact our support team at support@mcat-elite.com to explore options for reactivating your account. Reactivation requests for accounts terminated due to violations of our Terms of Service may not be honored.

Disclaimers and Limitation of Liability

By using the MCAT Elite website and services, you acknowledge and agree to the following disclaimers and limitations of liability. These terms are designed to limit our liability and clarify the extent of our responsibilities to you, the user.

1. No Guarantee of Results

While we provide high-quality study resources, practice materials, and tools designed to help you prepare for the MCAT, MCAT Elite does not guarantee any specific outcome, including but not limited to MCAT scores, acceptance to medical school, or success in any other academic endeavors. Your success depends on many factors, including but not limited to your own effort, prior knowledge, and test-taking strategies.

2. Availability of Services

The MCAT Elite website and services are provided on an "as is" and "as available" basis. While we strive to keep our services available and running smoothly, we cannot guarantee that the services will be uninterrupted, error-free, or free from harmful elements such as viruses. We reserve the right to suspend or discontinue any service at any time without prior notice. In case of any disruption, we will make reasonable efforts to restore service as quickly as possible.

3. Subscription Cancellation

Subscribers may cancel their subscription at any time by following the instructions in their account settings or contacting our support team at support@mcat-elite.com. Upon cancellation, access to paid content will continue until the end of the current billing cycle, unless otherwise specified. MCAT Elite does not offer partial refunds for canceled subscriptions, and no refunds will be provided for any unused portion of a subscription term.

4. Account Deletion

You have the right to delete your MCAT Elite account at any time. To delete your account, please contact our support team at support@mcat-elite.com. Upon deletion, all of your personal data, progress, and account information will be permanently removed from our system, subject to applicable legal requirements for data retention. Please note that once your account is deleted, it cannot be recovered, and any paid subscription will be automatically canceled.

5. Limitation of Liability

To the fullest extent permitted by law, MCAT Elite and its affiliates, employees, agents, and partners shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, data loss, or other intangible losses, arising from (a) your use of, or inability to use, our services; (b) any actions taken or not taken based on your use of the services; or (c) any breach of these Terms of Service by you or a third party.

6. Exclusion of Warranties

We do not warrant or make any representations regarding the accuracy, reliability, or completeness of any content, materials, or services available through MCAT Elite. Any content downloaded or otherwise obtained through the use of our services is done at your own risk, and you will be solely responsible for any damage to your computer system or data loss that results from downloading or accessing such content.

7. Indemnification

Governing Law and Dispute Resolution

These Terms of Service and any disputes arising out of or related to your use of MCAT Elite are governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of laws principles.

1. Informal Resolution

If a dispute arises between you and MCAT Elite, we encourage you to contact us first at support@mcat-elite.com to seek an informal resolution. We will make reasonable efforts to resolve disputes amicably within 30 days of receiving notice of the issue.

2. Arbitration Agreement

For disputes that cannot be resolved informally, you agree to resolve any claims through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall take place in Arizona, and the language of arbitration shall be English.

3. Exceptions to Arbitration

You or MCAT Elite may seek relief in a court of competent jurisdiction in Arizona for claims related to intellectual property infringement or other equitable relief.

4. Waiver of Class Actions

You agree to resolve disputes with MCAT Elite on an individual basis and waive the right to participate in class, consolidated, or representative actions.

Miscellaneous

1. Entire Agreement

These Terms of Service, along with our Privacy Policy, constitute the entire agreement between you and MCAT Elite regarding the use of our services. They supersede any prior agreements or understandings, whether written or oral.

2. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.

3. No Waiver

5. Force Majeure

MCAT Elite shall not be held responsible for delays or failures in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, government actions, labor strikes, and technical failures.
